Bushwack and Schlosser Secure Summary Judgment

On March 24, 2017, Jacqueline Bushwack and Brian S. Schlosser obtained Summary Judgment on behalf of Novartis Pharmaceuticals Corporation in a premises liability case venued in Kings County.  Plaintiff was an employee of an outside security contractor and allegedly slipped and fell on water while performing his duties patrolling Novartis’ manufacturing plant.

Following a lengthy oral argument, Justice Edgar G. Walker summarily dismissed Plaintiff’s Complaint based upon the Defendant’s arguments that it did not create or have notice of the alleged defective condition and that plaintiff slipped and fell on the very condition that he was hired to discover.  Nelson Reaves v.
