Hardy defeats motion for summary judgment

Tamika Hardy successfully defeated a CPLR 3213 motion for summary judgment in the Supreme Court, Nassau County on behalf of client Dominick Golia, M.D. in an action wherein the plaintiff, George Hyman, M.D., another doctor, attempted collect on a guarantee executed by Dr. Golia in connection with his purchase of Dr. Hyman’s medical practice.  The Court found that, while a guarantee may constitute an instrument for the payment of money, by alleging that Dr. Hyman impaired the goodwill of the medical practice, Dr. Golio asserted a legitimate defense to defeat the motion for summary judgment pursuant to CPLR 3213.
