Richman Speaks about the Challenges to Early Resolution of Med Mal Claims

David Richman was quoted in the Healthcare Risk Management article, “Take the Right Steps to Speed Resolution of Malpractice Litigation.” The story explains what risk managers and in-house counsel can do to speed and streamline the resolution of a medical malpractice case.

David noted that, of all the tort claims, medical malpractice claims are the most challenging to resolve early, given the requirement that providers adhere to a determined standard of care. Since “both the question of the standard and whether the treatment met the standard is often the focus of the dispute,” these are not issues that are “generally determinable at the outset of litigation.”
