Schieber Secures Victory In Enforceability of a Forum Selection Clause

Evan Schieber secures a victory for a Condominium client concerning the enforceability of a forum selection clause.  The Court upheld a forum selection provision in  a settlement agreement that favored the Condominium.  The decision is noteworthy as it, for the first time, called into question the enforceability of a forum selection over a seemingly competing general jurisdiction clause within the same agreement.  The Court rejected the plaintiff’s contention that the general jurisdiction clause took precedence over the forum selection provision.
