Lewis featured in “SCOTUS’s Section 230 Rulings Will Likely Reverberate Beyond BigTech”

Shari Lewis was quoted in the New York Law Journal article, “SCOTUS’s Section 230 Rulings Will Likely Reverberate Beyond BigTech.”

The Supreme Court is scheduled to hear two cases that could potentially change Section 230 of the 1996 Communications Decency Act. This act currently protects social media platforms from being held responsible for content posted by the users.

Rivkin Radler Partner, Shari Lewis notes, “While Big Tech is the defendant in these cases, an adverse ruling could impact providers of all sizes as the statute doesn’t distinguish between “Meta and Steve down the road.”

“The ISPs companies would certainly have to relook and redefine their delivery system. Maybe revamp the notorious algorithms that decide on delivery,” Lewis explained. She added, “They might be able to resort to more robust consent and inform provisions before people are allowed to use their platforms.”
